U.S. COURT RULES SEX-CHANGE OPERATION IS A TAX DEDUCTION

Just As consumers can take a tax deduction for their home office expenses and 1/2 of their business meals and lodging, American taxpayers can now take a tax deduction for their sex-change operations.

Tuesday February 2, 2010, the United States Tax Court ruled that a Massachusetts woman can write off the $25,000 charge for her hormone therapy and gender-reassignment surgery because the procedures was medically necessary.

Rhiannon O’Donnabhain, who was born male, sued the Internal Revenue Service back in 2007 after the agency had denied her the $5,000 deduction deeming the procedures “cosmetic.”

In an opinion that could have a far-reaching effect on transgender Americans worldwide, the Tax Court stated that it found the IRS’ argument “at best a superficial characterization of the circumstances” and one that was “thoroughly rebutted by the medical evidence,”.

ABC World News Tonight reported that “Gender identity disorder" The U.S. Tax Court agreed and stated for the record that "It is a well-recognized and serious mental disorder,”. By the way, this was the opinion of the majority of the justices.
